Storesight Data Services Privacy Policy

Storesight Data Services is concerned about your privacy and the security about your personal information, particularly how it is used and shared, and appreciates your trust that it will be protected through compliance with the terms of this policy (“Privacy Policy”). This Privacy Policy provides you with notice of Storesight Data Services’ practices for collecting, using, maintaining, protecting, and disclosing your personal information. By visiting the Storesight Data Services (as defined below), you are accepting the practices described in this Privacy Policy.
For purposes of this Privacy Policy, (a) "Field Agent," “Storesight Data Services,” “Storesight.com,” “Storesight”, “StoresightAI”, "we," "us," or "our" means Field Agent Inc., a Delaware corporation d/b/a “Storesight Data Services” d/b/a “Storesight.com”, (b) "Site" means the Storesight Data Services website located at www.storesight.com, www.marketplace.fieldagent.net, and any successor or replacement websites, (c) "Services" means any product or service sold through the Storesight Data Services on or through the Site, including Storesight AI (d) "Affiliate" means any entity controlled by, in control of, or under common control with Storesight Data Services, (e) “Marketplace” means the Site and any other software or programs offered by Storesight Data Services, (f) “Users”, “you” or “your” means Clients who engage with the Marketplace.
1. Users’ Personal Information Gathered by Storesight Data Services
A. Information You Provide
We receive and store any information you provide to us on the Marketplace or give us in any other way, including the following:
i. Registration Information. To register on the Marketplace you must provide us with your name, company name, and a valid email address;
ii. Payment and Tax Information. In order to process payment transactions, Users may also be required to provide payment account or credit card information and certain tax information; and
iii. Feedback. We collect any information Users provide to us in response to feedback requests (together with Registration Information and Payment and Tax Information, “Personal Information”).
B. Information Collected Through Automatic Data Collection Technologies
Additionally, we automatically receive and store certain types of information whenever you interact with us. This includes certain types of information about your use of the Marketplace, including information about your interaction with content and services available through the Marketplace.
Like many websites, we and certain business partners may use cookies, tracking pixels, and similar tracking technologies (collectively, "Cookies") when you use or access the Marketplace or visit a third-party website through which we provide Services. We use Cookies to recognize you as a User; understand how you navigate through the Marketplace; customize Services and other content to specific Users; measure the effectiveness of certain trials, promotions or other opportunities; perform a wide range of analytics; to mitigate risk and prevent potential fraud; and otherwise obtain information when your web browser or devices accesses the Marketplace, Services, and other content served by or on behalf of Storesight Data Services on other websites. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be accessed every time you use the Marketplace.
You have the right to choose whether or not to accept Cookies. However, certain Services are only available through the use of Cookies, so if you choose to disable or decline Cookies, your use of certain Services may be limited or not possible. Most web browsers are set to accept Cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser Cookies. To do so, please follow the instructions provided by your browser which are usually located within the "Help" or “Preferences” menu.
Do Not Track: Do Not Track ("DNT") is an optional browser setting that allows you to express your preferences regarding tracking by advertisers and other third-parties. We do not respond to DNT signals.

Information from Other Sources: We might receive information about you from other sources, such as updated delivery and address information from our carriers, which we use to correct our records.
Communications: By registering on the Marketplace, you will receive emails from Storesight Data Services and/or its Affiliates. As a Storesight Data Services User, it will be necessary for us to communicate with you to provide essential operational, status and transaction updates as well as notices in connection with your account and other information relevant to your participation and use of the Marketplace (collectively, “Core Communications”). You may not opt out of such Core Communications, and you agree to your receipt of Core Communications via email and/or other communication methods provided by you in your account registration. If we send non-Core Communications, such as newsletters, we will give you the opportunity to unsubscribe to them.
2. Storesight Data Services Use of Personal Information Received
Storesight Data Services collects and uses your personal information to:
Take and handle orders, deliver products and services, process payments, and communicate with you about orders, products and services, and promotional offers;
Provide functionality, analyze performance, fix errors, and improve the usability and effectiveness of the Marketplace;
Recommend features, products, and services that might be of interest to you, identify your preferences, and personalize your experience with Storesight Data Services;
In certain cases, comply with laws and other legal obligations;
Communicate with you in relation to the Marketplace via different channels (e.g., by phone, email, chat);
Prevent and detect fraud and abuse in order to protect the security of our customers, Storesight Data Services, and others. We may also use scoring methods to assess and manage credit risks;
Create and manage your account;
Display content that is customized to your account; and
Achieve any other purposes we describe to you when you provide the information or that you consent to.
3. Disclosure of Personal Information Received
Personal information about our users is an important part of our business, and we are not in the business of selling it to others. We share customers' personal information only as described below.
Users: As a User, we may share certain information in order to facilitate the relationship outlined in the Conditions of Use and any agreement between Storesight Data Services and its Users. We may also share certain information with third-party partners for the purpose of improving or expanding our Marketplace and/or the Services that we offer and provide.
Agents: We employ third-party companies and individuals to perform functions on our behalf. Examples include fulfilling orders for products or services, delivering packages, sending postal mail and email, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing payments, transmitting content, scoring, assessing and managing credit risk, and providing customer service. These third-party service providers have access to personal information needed to perform their functions, but may not use it for other purposes.
Promotional Offers: We may also send offers to selected groups of Users on behalf of other businesses. When we do this, we do not give that business your personal information. If you do not want to receive such offers, we will give you the opportunity to unsubscribe to them.
Business Transfers: As we continue to develop our business, we might sell or buy additional services or business units. In such transactions, User information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Notice (unless, of course, the User notifies us otherwise). Also, in the event that Storesight Data Services or substantially all of its assets are acquired, User information will, of course, be one of the transferred assets.
Protection of Storesight Data Services and Others: We release account and other personal information when we believe release is appropriate to comply with the law; enforce or apply our Conditions of Use Agreement; or protect the rights, property, or safety of Storesight Data Services, our Users, or others. Obviously, however, this does not include selling, renting, sharing, or otherwise disclosing personally identifiable information from Users for commercial purposes in violation of the commitments set forth in this Privacy Notice.
4. Rights to Access
If you create an account with Storesight Data Services, you may review your account information at any time and, if needed, may edit such information by contacting our support team. You can also close your account by contacting us with a request that we delete your account and information. We will take steps to delete your information as soon as practical, but some information may remain in archived/backup copies for our records and as otherwise required by law.
5. Conditions of Use; Notices and Revisions
If you choose to visit or use our Marketplace, your visit and any dispute over privacy is subject to this Privacy Notice, and our Conditions of Use, including limitations on damages, arbitration of disputes, waiver of jury trial, and application of the law of the state of Arkansas. If you have any concern about privacy at Storesight Data Services, please contact us with a thorough description, and we will try to resolve it.
Our business changes constantly, and our Privacy Policy and the Conditions of Use may also change. The date the Privacy Policy was last revised is identified at the top of the page. We may email periodic reminders of our notices and conditions, but you should check our Site frequently to see the most current version of the Privacy Policy. You are responsible for ensuring we have an up-to-date, active, and deliverable email address for you and for periodically reviewing our Privacy Policy for changes. Unless stated otherwise, our current Privacy Notice applies to all Personal Information that we have about you and your account. We stand behind the promises we make, however, and will never materially change our policies and practices to make them less protective of user information collected in the past without the consent of affected users.
6. Your State Privacy Rights
Depending on your state of residency, you may have certain rights related to your personal data, particularly:
the right to know if your data is being processed;
the right to access your personal data in a portable format;
the right to correct and/or complete your personal data;
the right to delete certain personal data;
the right to data portability;
the right to limit or require consent before your sensitive data is processed; and/or
the right to opt out of personal data processing for sales, targeted advertising and profiling in furtherance of decisions that produce legal or similarly significant effects.
Please consult your local privacy laws to better understand your data privacy rights as a consumer. Storesight Data Services will comply with applicable state law. You will not be knowingly discriminated against because you have exercised your data privacy rights under your applicable state law.
California Residents:
If you are a California resident, this privacy policy is supplemented by the California Consumer Protection Act (“CCPA”) and the California Privacy Rights Act (“CPRA” together with CCPA, “CCPA/CPRA”). Please note that the rights described below are not absolutely guaranteed and that we are only required to honor these rights as they apply under CCPA/CPRA. Please consult CCPA/CPRA to determine the rights available to you and when access to these rights may be limited.
i. Consumer Rights. Under the CCPA/CPRA you have the right to confirm that your personal information was processed and if so, request the disclosure of: the categories of personal information collected, sources from which the information was collected, the commercial purpose for collecting, selling or sharing personal information, the categories of third parties to whom we disclose personal information and the specific pieces of personal information we collected about you. You also have the right to access, correct, complete or delete pieces of personal information that we collect about you. You have the right to limit our use and disclosure of your sensitive personal information, and the right to opt out of your personal information being sold or shared. You have the right not to receive discriminatory treatment for exercising your rights under CCPA/CPRA.
ii. Third-party disclosure. California Civil Code Section § 1798.83 permits Users of the Storesight Data Services who are California residents to request and obtain from us a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge. Under Section 1798.83, Storesight Data Services currently does not share any personal information with third parties for their direct marketing purposes. If your Storesight Data Services account has a California mailing address, we will not share personal information we collect about you except to the extent permitted under California law. 7. How We Retain Your Personal Data
We keep the categories of personal data described in this policy for as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as maintaining Services, operating Storesight Data Services, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain personal data. At the end of the retention period, personal data will be deleted, destroyed, or deidentified.
8. How Secure Is Information About Me?
We protect your information during transmission by using Secure Socket Layer (SSL) software, which encrypts information you input.
It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when you have finished using a shared computer. We are not responsible for circumvention of any privacy settings or security measures contained through Storesight Data Services or on the Site. It is your responsibility to protect the security of your login information. Please help keep your account safe by using a strong password. The safety and security of your information also depends on you. Although we do our best to protect your Personal Information, we cannot guarantee the security of it, and all transmissions are at your own risk.
9. Children
Our Privacy Policy and Conditions of Use Agreement expressly limit Users to individuals who are 18 years of age or older, and our Marketplace is not intended for children under 18 years of age. We do not knowingly collect personal information from children under 18, and if we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information.
